PoolSpartan Terms of Service

1. Who these terms are between

These terms apply to your use of the PoolSpartan platform (“PoolSpartan”, “the Service”). PoolSpartan is provided by Zona Vibes, LLC, an Arizona limited liability company (“we”, “us”).

By signing up, signing in, or using PoolSpartan, you agree to these terms. If you don't agree, don't use it.

2. Who can use PoolSpartan

You can use PoolSpartan if you are at least 18 years old and have the authority to bind the business you are signing up on behalf of (if applicable). PoolSpartan is offered to pool service businesses (and people running them) for legitimate business use.

3. Your account

  • You are responsible for keeping your sign-in credentials private.
  • You are responsible for activity that happens under your account, including activity by people you authorize.
  • Notify us at security@poolspartan.com if you believe your account has been compromised.
  • We may suspend or terminate your account if you violate these terms.

4. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or disassemble PoolSpartan except as permitted by law.
  • Access or attempt to access another business's data without authorization.
  • Interfere with PoolSpartan's security, infrastructure, or other users' use of it.
  • Use PoolSpartan to violate any law or third party's rights, or to process payments for unlawful goods or services.
  • Submit content (notes, photos, customer data, etc.) that is unlawful, harassing, or infringes someone else's rights.

5. Fees and payment processing

Use of PoolSpartan's software features is provided at no subscription cost. We earn revenue through fees on payments processed through the platform via Stripe Connect. Payment processing fees are disclosed in-product before you connect a payout account or transact.

You are responsible for any taxes (sales, use, VAT, GST) arising from your business activity. PoolSpartan provides tools to help you collect applicable taxes; it does not file taxes on your behalf.

Chargebacks, refunds, and disputed transactions follow the rules of the card networks and our payments partner. Where a chargeback or refund is initiated, the corresponding amount (plus any related fees) may be debited from your connected account.

6. Data ownership and use

  • Your business data is yours. Customers, locations, equipment, visit history, invoices, and payment records belong to your business. We process them on your behalf as a data processor.
  • Content you submit (notes, photos, procedure responses) remains yours. By submitting it through PoolSpartan, you grant us the rights necessary to store, process, and transmit it as part of providing the service.
  • Customer data. When you add a customer to PoolSpartan, you represent that you have the right to do so and that your use of PoolSpartan to communicate with and bill that customer is consistent with your privacy commitments to them.

7. Software license

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use PoolSpartan for your own legitimate business purposes. This license ends automatically when these terms terminate.

PoolSpartan, its content, and all related intellectual property remain ours (or our licensors').

8. Third-party services

PoolSpartan uses third-party services (Clerk for auth, Stripe for payments, Google Maps for geocoding, Resend for email, Twilio for SMS, Sentry for diagnostics, and the FieldSpartan mobile app for field operations). Your use of those services through PoolSpartan is also subject to their respective terms, where applicable.

9. Updates

PoolSpartan is a continuously updated service. We may change features, add features, or remove features at any time. We will not knowingly remove a feature in a way that is intended to harm your business.

10. Disclaimers

PoolSpartan is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties — express, implied, and statutory — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that PoolSpartan will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of PoolSpartan.

Our total liability under or in connection with these terms will not exceed $100 or the total payment-processing fees we collected from you in the 12 months before the claim, whichever is greater.

Some jurisdictions don't allow these limitations. To the extent they don't apply, our liability is limited to the fullest extent allowed by law.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from (a) your violation of these terms, (b) your misuse of PoolSpartan, or (c) your business operations conducted through PoolSpartan.

13. Termination

You can stop using PoolSpartan at any time by closing your account. We can suspend or terminate your access at any time, including if you violate these terms or fail to comply with our payments partner's requirements. Sections that by their nature should survive termination will survive.

14. Changes to these terms

We may update these terms. Material changes will be announced via email or in-product at least 14 days before they take effect. Continued use after that date means you accept the new terms.

15. Governing law and disputes

These terms are governed by the laws of Arizona, excluding conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to that jurisdiction.
